Litigation Procedures

EEOC files employment discrimination lawsuits in select cases. When deciding whether to file a lawsuit, EEOC will consider several factors, including the seriousness of the violation, the type of legal issues in the case, and the wider impact the lawsuit could have on EEOC efforts to combat workplace discrimination. Because of limited resources, EEOC cannot file a lawsuit in every case where discrimination has been found.

The Regional Attorneys' Manual contains detailed information on the structure and functions of the EEOC's Office of General Counsel (OGC), OGC policies and procedures, and Commission policies; discusses prelitigation procedures, delegation of litigation authority, and obtaining approval for cases requiring General Counsel or Commission authorization; and covers various trial practice matters, settlement standards and procedures, appeal procedures, and the professional responsibilities of OGC attorneys.
