Targeted Disabilities

As of September 30, 2008, DOE employed 118 (0.76%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 309 IWTD were needed. This represented a decrease of 4 employees from FY 2007 and a decrease of one employee since FY 2004. The participation rate for FY 2007 was 0.82% and for FY 2004 was 0.79%. Over the 5-year period DOE had a net decrease of 0.03% in employees with targeted disabilities.

EEO Complaint Processing

I. Counseling

DOE timely processed 62.9% of the 97 pre-complaint counselings (without remands) completed in FY 2008.

II. Bases of Complaints Filed

The bases of alleged discrimination most often raised were: (1) Reprisal; (2) Age; and (3) Race (Black/African American). Of the 47 complaints filed at DOE, 18 contained allegations of race (Black/African American) discrimination, 5 contained allegations of race (White) discrimination, 1 contained an allegation of race (Asian) discrimination, 5 contained allegations of color discrimination and 16 contained allegations of disability discrimination.

III. Complaint Processing Times

Of the 44 completed investigations, 59.1% were timely. DOE's average time for completing an investigation was 290 days. Of the agencies completing 25 or more investigations, the U.S. Postal Service had the lowest average of 103 days.

DOE's average processing time for all complaint closures decreased from 429 days in FY 2007 to 305 days in FY 2008. The government-wide average was 336 days.

IV. Costs

DOE agreed to pay $122,150 for 14 pre-complaint settlements, of which 6 were monetary settlements averaging $20,358. DOE expended a total of $122,546 for 44 complaint investigations, for an average expenditure of $2,785.

DOE agreed to pay a total of $412,820 plus other benefits for 17 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 9 complaint closures with monetary benefits, the average award was $45,869.
