Targeted Disabilities

As of September 30, 2008, HHS employed 596 (0.79%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 1,514 IWTD were needed. This is the same as the number of employees in FY 2007 and a decrease of 55 employees since FY 2004. The participation rate for FY 2007 was 0.81% and for FY 2004 was 1.02%. Over the 5-year period HHS had a net decrease of 0.23% in employees with targeted disabilities.

EEO Complaint Processing

I. Counseling

HHS timely processed 67.7% of the 672 pre-complaint counselings (without remands) completed in FY 2008.

II. Bases of Complaints Filed

The bases of alleged discrimination most often raised were: (1) Reprisal; (2) Age; and (3) Sex (Female). Of the 379 complaints filed at HHS, 82 contained allegations of race (Black/African American) discrimination, 43 contained allegations of race (White) discrimination, 13 contained allegations of race (Asian) discrimination, 28 contained allegations of race (American Indian/Alaska Native) discrimination, 45 contained allegations of color discrimination and 110 contained allegations of disability discrimination.

III. Complaint Processing Times

Of the 225 completed investigations, 75.6% were timely. HHS' average time for completing an investigation was 204 days. Of the agencies completing 25 or more investigations, the U.S. Postal Service had the lowest average of 103 days.

HHS' average processing time for all complaint closures decreased from 397 days in FY 2007 to 297 days in FY 2008. The government-wide average was 336 days.

IV. Costs

HHS agreed to pay $9,283 for 37 pre-complaint settlements, of which 4 were monetary settlements averaging $2,320. HHS expended a total of $847,327 for 225 complaint investigations, for an average expenditure of $3,765.

HHS agreed to pay a total of $1,234,489 plus other benefits for 95 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 43 complaint closures with monetary benefits, the average award was $28,709.
