As of September 30, 2008, STATE employed 84 (0.34%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 495 IWTD were needed. This is the same as the number of employees in FY 2007 and a decrease of 9 employees since FY 2004. The participation rate for FY 2007 was 0.33% and for FY 2004 was 0.39%. Over the 5-year period STATE had a net decrease of 0.05% in employees with targeted disabilities.
I. Counseling
STATE timely processed 63.4% of the 191 pre-complaint counselings (without remands) completed in FY 2008.
II. Bases of Complaints Filed
The bases of alleged discrimination most often raised were: (1) Reprisal; (2) Sex (Female); and (3) Race (Black/African American). Of the 106 complaints filed at STATE, 28 contained allegations of race (Black/African American) discrimination, 5 contained allegations of race (White) discrimination, 5 contained allegations of race (Asian) discrimination, 2 contained allegations of race (American Indian/Alaska Native) discrimination, 15 contained allegations of color discrimination and 17 contained allegations of disability discrimination.
III. Complaint Processing Times
Of the 98 completed investigations, 7.1% were timely. STATE's average time for completing an investigation was 307 days. Of the agencies completing 25 or more investigations, the U.S. Postal Service had the lowest average of 103 days.
STATE's average processing time for all complaint closures decreased from 436 days in FY 2007 to 348 days in FY 2008. The government-wide average was 336 days.
IV. Costs
STATE agreed to pay $1,011 for 9 pre-complaint settlements, of which 1 was a monetary settlements. STATE expended a total of $178,740 for 98 complaint investigations, for an average expenditure of $1,823.
STATE agreed to pay a total of $295,882 plus other benefits for 13 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 7 complaint closures with monetary benefits, the average award was $42,269.
