As of September 30, 2008, VA employed 3,985 (1.43%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 5,579 IWTD were needed. This represented an increase of 227 employees over FY 2007 and an increase of 293 employees since FY 2004. The participation rate for FY 2007 was 1.48% and for FY 2004 was 1.56%. Over the 5-year period VA had a net decrease of 0.13% in employees with targeted disabilities.
I. Counseling
VA timely processed 96.1% of the 3,993 pre-complaint counselings (without remands) completed in FY 2008.
II. Bases of Complaints Filed
The bases of alleged discrimination most often raised were: (1) Reprisal; (2) Race (Black/African American); and (3) Age. Of the 2,111 complaints filed at VA, 511 contained allegations of race (Black/African American) discrimination, 105 contained allegations of race (White) discrimination, 33 contained allegations of race (Asian) discrimination, 4 contained allegations of race (American Indian/Alaska Native) discrimination, 64 contained allegations of color discrimination and 505 contained allegations of disability discrimination.
III. Complaint Processing Times
Of the 1,414 completed investigations, 62.8% were timely. VA's average time for completing an investigation was 185 days. Of the agencies completing 25 or more investigations, the U.S. Postal Service had the lowest average of 103 days.
VA's average processing time for all complaint closures remained constant between FY 2007 and FY 2008 at 366 days. The government-wide average was 336 days.
IV. Costs
VA agreed to pay $371,883 for 275 pre-complaint settlements, of which 33 were monetary settlements averaging $11,269. VA expended a total of $4,923,035 for 1,414 complaint investigations, for an average expenditure of $3,481.
VA agreed to pay a total of $4,620,981 plus other benefits for 432 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 182 complaint closures with monetary benefits, the average award was $25,390.
