As of September 30, 2008, NAVY employed 1,398 (0.78%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 3,601 IWTD were needed. This represented an increase of 18 employees over FY 2007 and a decrease of 164 employees since FY 2004. The participation rate for FY 2007 was 0.8% and for FY 2004 was 0.88%. Over the 5-year period NAVY had a net decrease of 0.1% in employees with targeted disabilities.
I. Counseling
NAVY timely processed 76.1% of the 1,275 pre-complaint counselings (without remands) completed in FY 2008.
II. Bases of Complaints Filed
The bases of alleged discrimination most often raised were: (1) Reprisal; (2) Race (Black/African American); and (3) Age. Of the 670 complaints filed at NAVY, 190 contained allegations of race (Black/African American) discrimination, 44 contained allegations of race (White) discrimination, 43 contained allegations of race (Asian) discrimination, 2 contained allegations of race (American Indian/Alaska Native) discrimination, 77 contained allegations of color discrimination and 173 contained allegations of disability discrimination.
III. Complaint Processing Times
Of the 329 completed investigations, 43.8% were timely. NAVY's average time for completing an investigation was 237 days. Of the agencies completing 25 or more investigations, the U.S. Postal Service had the lowest average of 103 days.
NAVY's average processing time for all complaint closures decreased from 310 days in FY 2007 to 288 days in FY 2008. The government-wide average was 336 days.
IV. Costs
NAVY agreed to pay $196,663 for 131 pre-complaint settlements, of which 13 were monetary settlements averaging $15,127. NAVY expended a total of $3,003,770 for 329 complaint investigations, for an average expenditure of $9,130.
NAVY agreed to pay a total of $2,857,963 plus other benefits for 233 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 71 complaint closures with monetary benefits, the average award was $40,253.
