As of September 30, 2008, EPA employed 191 (1.05%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 365 IWTD were needed. This represented an increase of 6 employees over FY 2007 and a decrease of 4 employees since FY 2004. The participation rate for FY 2007 was 1.02% and for FY 2004 was 0.84%. Over the 5-year period EPA had a net increase of 0.21% in employees with targeted disabilities.
I. Counseling
EPA timely processed 57% of the 114 pre-complaint counselings (without remands) completed in FY 2008.
II. Bases of Complaints Filed
The bases of alleged discrimination most often raised were: (1) Reprisal; (2) Race (Black/African American); and (3) Age. Of the 73 complaints filed at EPA, 29 contained allegations of race (Black/African American) discrimination, 6 contained allegations of race (White) discrimination, 1 contained an allegation of race (Asian) discrimination, 15 contained allegations of color discrimination and 17 contained allegations of disability discrimination.
III. Complaint Processing Times
Of the 24 completed investigations, 91.7% were timely. EPA's average time for completing an investigation was 208 days. Of the agencies completing 25 or more investigations, the U.S. Postal Service had the lowest average of 103 days.
EPA's average processing time for all complaint closures increased from 450 days in FY 2007 to 464 days in FY 2008. The government-wide average was 336 days.
IV. Costs
EPA reported paying no monetary benefits for 2 pre-complaint settlements. EPA expended a total of $90,880 for 24 complaint investigations, for an average expenditure of $3,786.
EPA agreed to pay a total of $59,410 plus other benefits for 12 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For the 7 complaint closures with monetary benefits, the average award was $8,487.
