As of September 30, 2009, EPA employed 240 (1.30%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 369 IWTD were needed. This represents an increase of 49 employees over FY 2008 and an increase of 43 employees since FY 2005. The participation rate for FY 2008 was 1.05% and for FY 2005 was 1.07%. Over the 5-year period EPA had a net increase of 0.23% in employees with targeted disabilities.
EPA timely processed 74.4% of the 121 pre-complaint counselings (without remands) completed in FY 2009.
The bases of alleged discrimination most often raised were: (1) Age; (2) Race (Black/African American); and (3) Sex (Female). Of the 77 complaints filed at EPA, 30 contained allegations of race (Black/African American) discrimination, 2 contained allegations of race (White) discrimination, 3 contained allegations of race (American Indian/Alaska Native) discrimination, 3 contained allegations of color discrimination and 26 contained allegations of disability discrimination.
Of the 73 completed investigations, 93.2% were timely. EPA's average time for completing an investigation was 197 days. Of the agencies completing 25 or more investigations, the Tennessee Valley Authority had the lowest average of 100 days.
EPA's average processing time for all complaint closures decreased from 464 days in FY 2008 to 306 days in FY 2009. The government-wide average was 344 days.
EPA agreed to pay $27,000 for 10 pre-complaint settlements, of which 1 was a monetary settlement averaging $27,000. EPA expended a total of $252,650 for 73 complaint investigations, for an average expenditure of $3,461.
EPA agreed to pay a total of $399,830 plus other benefits for 16 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For complaint closures with monetary benefits, the average award was $24,989.
