Mediación

Hoy día la mediación es la forma mas popular de ADR usada por agencias en disputas relacionadas con el empleo. Mediación es la intervencion en una disputa o negociacion de una tercera parte que sea aceptable imparcial y neutral y que no tenga la autoridad de tomar decisiones. El objetivo de método intervencion es ayudar a que las partes lleguen a una Resolución de los puntos en disputa de una manera mutuamente aceptable.

Un mediador primordialmente hace sugerencias procesales relacionadas a cómo las partes pueden llegar a un acuerdo. Ocasionalmente, un mediador puede sugerir algunas opciones substantivas como un medio de alentar a las partes a expandir la esfera de posibles resoluciones bajo consideracion. A menudo, un mediador trabaja con las partes individualmente, en juntas, para explorar opciones de resoluciones aceptables para desarrollar propumétodos que puedan mover a las partes mas cerca a una resolucion.
