EEO-5 (Elementary-Secondary Staff Information Report) Data Collection

The Elementary – Secondary Staff Information Report (EEO-5), EEOC Form 168A, also referred to as the EEO-5 Report, is a mandatory biennial data collection that requires all public elementary and secondary school systems and districts with 100 or more employees to submit demographic workforce data, including data by race/ethnicity, sex, and activity assignment classification. The filing by eligible school systems or districts is required under section 709(c) of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. 2000e-8(c), 29 CFR 1602.39 and .41-.45.  Filers can find additional eligibility information at www.EEOCdata.org/eeo5.

The published deadline to submit and certify the 2022 EEO-5 Report was Tuesday, November 22, 2022. All filers who have not submitted and certified their mandatory 2022 EEO-5 Report by the November 22, 2022, deadline will have through Tuesday, January 10, 2023, to submit and certify their 2022 EEO-5 Report.

Please submit and certify your school system or district’s EEO-5 Report as soon as possible and no later than Tuesday, January 10, 2023, in order to comply with the EEOC’s mandatory filing requirements. Once the January 10, 2023, deadline passes, no additional 2022 EEO-5 Reports will be accepted, and filers will be out of compliance with their mandatory 2022 EEO-5 filing obligation. 

Filers should visit the dedicated EEO-5 website at www.eeocdata.org/eeo5 to access the EEO-5 Online Filing System (OFS). Filers needing additional assistance may learn how to access the EEO-5 OFS, as well as request additional assistance from the Filer Support Team, by submitting a request to the Message Center.
