Reg. 3821 (Jan. 21, 2011), the EEOC developed a Final Plan for Retrospective Review of Significant Regulations, consistent with legal requirements and EEOC's resources and regulatory priorities. It its most recent timeline for retrospective review, the EEOC projects the agency's retrospective regulatory review activities through 2023.

On March 8, 2011, the EEOC first sought public comments on the design of a Preliminary Plan for Retrospective Review of Significant Regulations (Preliminary Plan). EEOC received 50 comments between March and May 2011.
EEOC received 15 comments between August 2011 and February 2015.
