Targeted Disabilities

As of September 30, 2009, NRC employed 35 (0.84%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 83 IWTD were needed. This is the same as the number of employees in FY 2008 and an increase of 3 employees since FY 2005. The participation rate for FY 2008 was 0.86% and for FY 2005 was 0.97%. Over the 5-year period NRC had a net decrease of 0.13% in employees with targeted disabilities.

EEO Complaint Processing

I. Counseling

NRC timely processed 100% of the 16 pre-complaint counselings (without remands) completed in FY 2009.

II. Bases of Complaints Filed

The bases of alleged discrimination most often raised were: (1) Race (Black/African American); (2) Reprisal; and (3) Age. Of the 8 complaints filed at NRC, 6 contained allegations of race (Black/African American) discrimination, 3 contained allegations of race (Asian) discrimination, 3 contained allegations of color discrimination and 1 contained an allegation of disability discrimination.

III. Complaint Processing Times

Of the 7 completed investigations, 100% were timely. NRC's average time for completing an investigation was 198 days. Of the agencies completing 25 or more investigations, the Tennessee Valley Authority had the lowest average of 100 days.

NRC's average processing time for all complaint closures decreased from 343 days in FY 2008 to 259 days in FY 2009. The government-wide average was 344 days.

IV. Costs

NRC agreed to pay $5,000 for 2 pre-complaint settlements, of which 1 was a monetary settlement averaging $5,000. NRC expended a total of $22,363 for 7 complaint investigations, for an average expenditure of $3,195.

NRC agreed to pay a total of $41,350 plus other benefits for 11 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For complaint closures with monetary benefits, the average award was $3,759.
