根据第七条,求职者性别(除非是真正的职业资格(BFOQ)并且对某一特定职位或职业至关重要)、婚姻状况、怀孕、怀孕病史、未来生育计划、子女或受抚养人的数量和/或年龄、儿童保育计划、堕胎、节育、生育能力、配偶或子女的姓名或地址等问题,通常被视为与工作无关,且是有问题的。

表明或暗示对某性别(除非基于BFOQ)给予雇佣意向限制或特殊待遇的任何就业前询问,或只对某一性别而不对另一性别进行的任何询问,也同样很麻烦。
