McDonald’s Settlement (AMTCR)

On January 5, 2023, the U.S. Equal Employment Opportunity Commission (EEOC) reached final settlement in a class sexual harassment suit against AMTCR, Inc., AMTCR Nevada, Inc., and AMTCR California, LLC (AMTCR), a franchise owner operating approximately 18 McDonald’s restaurants in Nevada, Arizona and California. AMTCR agreed to pay $1,997,500 to provide monetary relief for harmed eligible victims. The EEOC’s suit was filed and resolved in the U.S. District Court of Nevada (EEOC v. AMTCR, Inc., et. al., Case No: 2:21-cv-01808).

According to the lawsuit, since at least 2017, AMTCR knew sexual harassment by supervisors, managers, and coworkers at various McDonald’s restaurants was occurring but allowed it to continue, unabated. The harassment was mainly directed at young male and female employees and included frequent unwanted touching, offensive comments, unwelcome sexual advances, and intimidation. This type of alleged conduct violates Title VII of the Civil Rights Act of 1964 which prohibits sexual harassment in the workplace.

Individuals who believe they have experienced inappropriate conduct of a sexual nature while working for an AMTCR franchised McDonald’s location may be eligible to receive monetary relief. In order for the EEOC to determine eligibility, you need to submit a Claim Form providing information about your experience to the EEOC. Please contact the EEOC at (213) 785-3095 Ext. 1, or, to begin the claims process. You will receive additional information and a Claim Form to complete and return in the near future.
