U.S. Supreme Court Denies United Airlines Petition

In a closely watched case, the U.S. Supreme Court issued a written order denying air transportation giant United Airlines's petition for high court review of a disability discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC).  This means the Seventh Circuit Court of Appeal's Sept. 7, 2012 decision will stand, holding that "reasonable accommodation" under the Americans with Disabilities Act (ADA) may require employers to provide employees with disabilities with "reassignment to a vacant position" when the employee cannot be accommodated in his or her current position.  (EEOC v. Supervalu / Jewel Food Held in Contempt for Breaching Consent Decree Settling Earlier EEOC Disability Discrimination Suit

A federal judge has held Supervalu, Inc., which owns the Jewel-Osco chain of stores, in contempt for failing to comply with conditions settling the U.S. Equal Employment Opportunity Commission's (EEOC) disability discrimination lawsuit against the company, the federal agency announced today.  The judge faulted Supervalu for failing to send written job offers to employees on a disability leave of absence who can be returned to work, as required under a consent decree entered by the court in 2011.  The court also ruled that the EEOC is entitled to discovery and further proceedings to determine whether the company violated the consent decree by failing to provide reasonable accommodations to employees who wanted to return to work from a disability leave of absence.

Jury Verdict for EEOC Against Western Trading Company In Disability Case

A unanimous jury in federal court in Denver yesterday found for the U.S. Equal Employment Opportunity Commission (EEOC) in its disability discrimination lawsuit against Western Trading Company, Inc., an Army-Navy surplus company in metro Denver (EEOC v. Western Trading Co., Inc., Case #10-cv-02387-MJM-MJW).  The jury awarded $109,000 for Tyler Riley, an employee who was fired because of his seizure disorder.

Judgment Against AutoZone Affirmed in EEOC Disability Discrimination Case

The U.S. Court of Appeals for the Seventh Circuit has affirmed a $424,000 judgment (including $9,000 in costs) against AutoZone, Inc. for violating the Americans with Disabilities Act (ADA), the U.S. Equal Employment Opportunity Commission (EEOC) announced today.  The decision also upholds an injunction requiring the national auto parts retailer to provide reasonable accommodations to employees with physical disabilities in all of its stores in central Illinois.

America's Thrift Stores of Alabama, Inc. will pay $50,000 and furnish other relief to settle a disability discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The EEOC had charged that the company violated federal law by refusing to provide an employee with a reasonable accommodation and subsequently firing her because of her disability, degenerative joint disease. America's Thrift buys new and used items from local charities and department stores to sell to the public, and operates 17 stores in five states.
