Targeted Disabilities

As of September 30, 2009, The Government employed 24,663 (0.88%) Individuals with Targeted Disabilities (IWTD). In order to have met the federal 2% participation rate goal, 56,226 IWTD were needed. This represents an increase of 236 employees over FY 2008 and a decrease of 479 employees since FY 2005. The participation rate for FY 2008 was 0.88% and for FY 2005 was 0.96%. Over the 5-year period The Government had a net decrease of 0.08% in employees with targeted disabilities.

EEO Complaint Processing

I. Counseling

The Government timely processed 90.2% of the 38,996 pre-complaint counselings (without remands) completed in FY 2009.

II. Bases of Complaints Filed

The bases of alleged discrimination most often raised were: (1) Reprisal; (2) Age; and (3) Disability (Physical). Of the 16,947 complaints filed at The Government, 4,023 contained allegations of race (Black/African American) discrimination, 1,309 contained allegations of race (White) discrimination, 393 contained allegations of race (Asian) discrimination, 128 contained allegations of race (American Indian/Alaska Native) discrimination, 1,610 contained allegations of color discrimination and 5,222 contained allegations of disability discrimination.

III. Complaint Processing Times

Of the 10,199 completed investigations, 72.9% were timely. The Government's average time for completing an investigation was 185 days. Of the agencies completing 25 or more investigations, the Tennessee Valley Authority had the lowest average of 100 days.

The Government's average processing time for all complaint closures increased from 336 days in FY 2008 to 344 days in FY 2009.

IV. Costs

The Government agreed to pay $3,715,972 for 6,735 pre-complaint settlements, of which 703 were monetary settlements averaging $5,286. The Government expended a total of $37,557,461 for 10,199 complaint investigations, for an average expenditure of $3,682.

The Government agreed to pay a total of $41,713,621 plus other benefits for 3,555 complaint closures through settlement agreements, final agency decisions, and final agency orders fully implementing AJ decisions. For complaint closures with monetary benefits, the average award was $11,734.
