Valero Refining – Texas L.P. Sued By EEOC For Disability Discrimination

The Houston District Office of the U.S. Equal Employment Opportunity Commission (EEOC) today filed suit against Valero Refining -- Texas L. P. (Valero). The EEOC suit, (Civil Action No. 3:10-cv-00398 in the U.S. District Court for the Southern District of Texas), alleges that Valero failed to accommodate Bobby Bass's disability for a safety test required to permit job assignment at its refinery, and discharged Mr. Bass because of his disability. The complaint alleges that Valero was a joint employer with Modern EPC, which hired Mr. Bass to work as a general foreman on a turnaround project at Valero's Texas City refinery. The complaint alleges that Valero removed and effectively discharged Mr. Bass from working at its refinery because he supposedly did not take the reading test.

Dental Association, L.P., doing business as Monarch Dental Associates, L.P. which operates a practice in Burleson, Texas, alleging that two female employees there were subjected to a sexually hostile work environment by the lead dentist.

Finch Air Conditioning Settles EEOC Lawsuit for Sexual Harassment of Young Female Employees

Finch Air Conditioning and Heating, Inc., located in La Porte, Texas, has agreed to pay $80,000 to settle claims of sexual harassment and constructive discharge of female employees brought by the U.S. Equal Employment Opportunity Commission (EEOC) in U.S. District Court for the Southern District of Texas, Houston Division.  In the suit (Civil Action No. 4:09-cv-03156), the EEOC alleged that female employees at Finch were routinely subjected to sexual harassment and discrimination in violation of Title VII of the Civil Rights Act of 1964, one of the civil rights/employment discrimination statutes the EEOC is charged with enforcing.

Cinram Wireless Pays $40,000 to Settle EEOC Religious Discrimination and Retaliation Suit

A Fort Worth, Texas CD and DVD manufacturing company has agreed to settle a religious discrimination and retaliation lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The EEOC had charged that the company refused to accommodate an employee's Sabbath, which is from sundown Friday through sundown Saturday, and then fired her in retaliation for complaining about the failure to accommodate her religion as a member of Soldiers of the Cross of Christ Church.

Two Sonic Drive-In franchises in the Kingwood-Humble area with common ownership and management will pay $55,000 to settle a sexual harassment lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today. The EEOC had charged that S.D.I. of Kingwood, doing business as the Kingwood Sonic Drive-In, and S.D.I. of Lee Rd., doing business as the Lee Road Sonic Drive-In, violated federal law by routinely subjecting teenaged female employees to abuse by a manager and others, including threatening one young worker with a knife.

A Sonic Drive-In in Grapevine, Texas, has agreed to settle a sexual harassment lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), for $31,000, the agency announced today. The EEOC's suit charged that SDI of Grapevine [2240 Hall Johnson Road], A Texas Partnership, subjected 17-year-old carhop Erin Schwarzbach to a sexually hostile work environment created by the general manager of the restaurant.

Early Agreement on Decree Ends EEOC Race Case Against Medical Device Supplier

A federal judge has entered a consent decree resolving a race discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC) against Conmed Linvatec, a Utica, N.Y.-based international medical device corporation specializing in orthopedics and general surgery.  Based upon an administrative investigation managed by EEOC Chicago District Director John Rowe, the agency had alleged that the company violated Title VII of the Civil Rights Act of 1964 by terminating Paul Hickman from its Midwest office in Elmhurst, Ill., on account of his race.
