Injunction, Attorney Fees Ordered Against EmCare in EEOC Sexual Harassment and Retaliation Case

Upon consideration of a request by the U.S. Equal Employment Opportunity Commission, U.S. District Judge Jorge A. Solis has directed EmCare, a physician outsourcing group based in Dallas, to end practices of sex discrimination and retaliation and to report any employee claims of sexual harassment to the agency for the next two years. The judge's action follows a jury verdict in October 2014 awarding $499,000 to three former employees in a sexual harassment and retaliation lawsuit the civil rights enforcement agency brought against EmCare.

Draper Development, LLC, doing business as Subway, which operates at least 24 Subway restaurants in the Albany area, violated federal law by subjecting two teenage female job applicants to sexual harassment when its manager offered them jobs in exchange for sex, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed on July 21, 2015.

A federal appeals court has refused to grant New Breed Logistics' petition for rehearing of a decision in favor of the U.S. Employment Opportunity Commission (EEOC), the federal agency announced today.  The denial of the petition upholds a jury verdict of over $1.5 million in EEOC's lawsuit against the High Point, N.C.-based logistics services provider for sexual harassment and retaliation against three temporary female employees.  New Breed had petitioned the full panel of the Sixth Circuit Court of Appeals to rehear the case.

The U.S. Equal Employment Opportunity Commission (EEOC) and the U.S. Department of Justice's (DOJ) Civil Rights Division yesterday signed a new Memorandum of Understanding (MOU) to further the goals of Title VII of the Civil Rights Act of 1964 in prohibiting employment discrimination in the state and local government sector.
