Social Media Is Part of Today's Workplace but its Use May Raise Employment Discrimination Concerns

The use of social media has become pervasive in today's workplace and, as a result, is having an impact on the enforcement of federal laws, a panel of experts told the U.S. Equal Employment Opportunity Commission (EEOC) at a meeting held today at EEOC Headquarters in Washington. EEOC and FTC Offer Joint Tips on Use of Employment Background Checks

The U.S. Equal Employment Opportunity Commission (EEOC) and the U.S. Federal Trade Commission (FTC) today co-published two technical assistance documents that explain how the agencies' respective laws apply to background checks performed for employment purposes.  One document is for employers; the other is for job applicants and employees.  This is the first time that the two agencies have partnered to create resources addressing concerns in this key area.

EEOC Releases FY 2013 Enforcement  And Litigation Data

The U.S. Equal Employment Opportunity Commission (EEOC) today released a comprehensive set of fiscal year 2013 data tables showing that the agency obtained the highest monetary recovery in agency history through its administrative process, increasing by $6.7 million to $372.1 million.  The data tables also provide detailed breakdowns for the 93,727 charges of workplace discrimination the agency received.  The fiscal year runs Oct. 1 to Sept. 30.

EEOC Sues Peters' Bakery for National Origin Harassment and Retaliation

Peters' Bakery, a family-owned business in East San Jose, violated federal law when the principal owner verbally abused an employee using ethnic and racial slurs, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed today.  Additionally, the EEOC said Peters' Bakery retaliated against the employee by suing her in small claims court for defamation after she filed a discrimination charge with the EEOC.

EEOC Sues Dart Energy and J&R Well Services for Race / National Origin Discrimination, Retaliation

A Michigan-based energy company and its Wyoming subsidiary violated federal law against race and national origin harassment and retaliation, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed yesterday.  The EEOC charged that Dart Energy Corp., headquartered in Mason, Mich., and its subsidiary J&R Well Services, LLC, which operates an oil and gas well service business in Wyoming, created a hostile work environment for a group of black, Hispanic and Native American employees.  Further, the EEOC said, the companies fired some of these employees because of their race/national origin and/or because they complained about the discrimination.

EEOC Sues Battaglia Distributing Company for Racial Discrimination

Battaglia Distributing Co., Inc., a Chicago wholesale food distributor located at 2500 South Ashland Avenue, permitted a hostile work environment where use of racial slurs was common, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed today.  According to the EEOC, slurs were used by both black and white supervisors to scold black employees.  In addition, frequent, offensive racial banter among hourly workers was routinely tolerated by management.

EEO-1 Survey for 2013 Opens Today

The Equal Employment Opportunity Commission (EEOC) announced today that it has completed its mailing of the 2013 EEO-1 survey Notification Letters. The EEO-1 is an annual survey that requires all private employers with 100 or more employees, and federal government contractors or first-tier subcontractors with 50 or more employees and a contract or subcontract of $50,000 or more, to file the EEO-1 report. The filing of the EEO-1 report is not voluntary, but is required by federal law. The filing deadline this year is Sept. 30, 2013.

Federal District Judge Milton Shadur has entered a consent decree resolving a sex hiring lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The case, 11-CV-879, was filed in the District Court for the Northern District of Illinois, Eastern Division.
