Builders FirstSource to Pay $26,000 to Settle EEOC Disability and Age Discrimination Lawsuit

Settlement resolves federal claims that construction materials supplier unlawfully rejected older temporary worker

SEATTLE – Building supply company Builders FirstSource (BFS) agreed to pay $26,000 to settle a disability and age discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the federal agency announced today.

According to the EEOC’s lawsuit, a 67-year-old worker was assigned by a staffing agency to work as a temporary assembler at BFS’s truss assembly facility in Arlington, Washington. The worker was qualified for the assembler position because he had worked at other physically demanding jobs. The suit said that in June 2023, after observing the worker briefly, BFS’s general manager regarded him as not suited to perform the job and asked for a replacement.

“The EEOC is committed to enforcing federal anti-discrimination laws,” said Elizabeth Cannon, director of the EEOC’s Seattle Field Office. “We encourage all employers to adopt measures and provide training to prevent discrimination.”

The suit charged the company with violating both the Age Discrimination in Employment Act (ADEA) and Title I of the Americans with Disabilities Act (ADA), which prohibit employment discrimination based on age and perceived disabilities. The EEOC filed suit (EEOC v. BFS Group LLC dba BFS Group of Washington LLC dba Builders FirstSource, Case No. 2:24-cv-01562) in U.S. District Court for the Western District of Washington, Seattle Division, after first attempting to reach a pre-litigation settlement through its administrative conciliation process.

Under the two-year consent decree signed on Dec. 29, 2025 resolving the lawsuit, Builders FirstSource will pay $26,000 to the worker, and work with a third-party consultant to review and/or revise its policies and procedures concerning age and disability discrimination and disability accommodation. The company will also train its officers, managers, supervisors, and human resources personnel on its policies and procedures.

EEOC San Francisco Regional Attorney Roberta Steele said, “Through this settlement with the EEOC, Builders FirstSource will review its policies and procedures and provide training to management and human resources personnel. The EEOC is pleased that this company acted promptly to resolve the suit.”
