EEOC v. United Parcel Service

The U.S. Equal Employment Opportunity Commission (EEOC) has filed a lawsuit against UPS alleging that UPS’s failure to hire deaf and hard of hearing individuals who have DOT hearing exemptions for certain jobs is illegal disability discrimination.

The lawsuit concerns jobs at UPS that involve driving DOT-regulated vehicles, such as Package Car Driver, Warehouse Delivery Driver, and Feeder Driver. The lawsuit was filed under the Americans with Disabilities Act.

The EEOC is interested in speaking with any individual who had a DOT card with a hearing exemption at any time between September 2019 and the present and who either:

  1. Applied for a driving job with UPS; or
  2. Decided not to apply for a driving job with UPS because of UPS’s policy against hiring individuals with DOT hearing exemptions.

The lawsuit was filed on September 22, 2023, in the United States District Court for the Northern District of Illinois.

The case is EEOC v. UPS, Civil Case No. 1:23-cv-14021 (N.D. Ill.)
