If you do not agree with the EEOC's decision on your appeal, you can ask for a reconsideration of that decision. A request for reconsideration is only granted if you can show that the decision involved a clearly erroneous interpretation of material fact or law, or if it will have a substantial impact on the policies, practices or operations of the agency. The agency also has the right to request reconsideration.
You must ask for reconsideration no later than 30 days after you receive our decision on your appeal.

You should send with your request all supporting documents and any statement you would like to make in support of your request. You must also give a copy of your request to the agency and include with your request proof that you have done this. The agency will then have 20 days from the day it receives your request to send a statement opposing your request, and the agency is required to give you a copy of any statement they send.
Once the Office of Federal Operations has made a decision on your request for reconsideration, the decision is final. If the decision sends a complaint back to the agency for further action, you still will have the right to appeal and the right to ask for a review of any agency order or Administrative Judge decision issued thereafter.
