On August 30, 2021, the U.S. District Court for the District of Minnesota ruled in favor of the EEOC, finding that Koch violated the law and discriminated against a class of women drivers who failed the strength test at Koch between February 2013 and January 2018. Women applicants who were not hired between February 2013 and January 2018 because they failed the CRT test are entitled to backpay.
