EEO-5 (Elementary-Secondary Staff Information Report) Data Collection

The Elementary – Secondary Staff Information Report (EEO-5), EEOC Form 168A, also referred to as the EEO-5 Report, is a mandatory biennial data collection that requires all public elementary and secondary school systems and districts with 100 or more employees to submit demographic workforce data, including data by race/ethnicity, sex, and activity assignment classification. The filing by eligible school systems or districts is required under section 709(c) of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. 2000e-8(c), 29 CFR 1602.39 and .41-.45.

Update:  2020 EEO-5 Data Collection Is NOW OPEN

After delaying the opening of the 2020 EEO-5 Data Collection on May 8, 2020 in light of the COVID-19 public health emergency, the 2020 EEO-5 Data Collection is NOW OPEN as of July 27th. The deadline for submitting 2020 EEO-5 data is Monday, October 4, 2021

Filers should visit the newly launched EEO-5 website at www.EEOCdata.org/eeo5 for the latest filing updates and additional information. By visiting the EEO-5 Filer Support Center located at www.EEOCdata.org/eeo5/support, filers can request assistance as well as find helpful resources, including the 2020 EEO-5 Instruction Booklet, FAQs and a Fact Sheet. Filers may also contact the EEO-5 Filer Support Team at EEO5FilerSupport@EEOCdata.org or toll free at 1-855-EEOC-035 (1-855-336-2035).

Eligible filers that have not received a 2020 EEO-5 notification letter via U.S. mail should contact the EEO-5 Filer Support Team at EEO5FilerSupport@EEOCdata.org for assistance.  Filers that have received the notification letter, may now create user accounts using the “Registration ID” and “Pin” provided in the notification letter.  

Once eligible school systems/districts have successfully created a user account using the Registration ID and Pin, there are two different ways to file 2020 EEO-5 Reports.

  1. ONLINE FORM:  Eligible public elementary/secondary school systems/districts may enter their data into a secure data entry form via the EEO-5 Online Filing System at www.EEOCdata.org/eeo5/signin.
  2. DATA FILE UPLOAD:   Eligible public elementary/secondary school systems/districts may upload data files through the EEO-5 Online Filing System.  The format of the upload data file MUST follow the file layout set forth in the EEOC-approved specifications available at www.EEOCdata.org/eeo5/howto.
