Dillard's to Pay $2 Million to Settle Class Action Disability Discrimination Lawsuit by EEOC

Dillard's Inc., a national retail chain, will pay $2 million and commit to extensive, company-wide injunctive relief to settle a class action disability discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  At issue was Dillard's longstanding national policy and practice of requiring all employees to disclose personal and confidential medical information in order to be approved for sick leave.  The settlement also resolves claims that Dillard's terminated a class of employees nationwide for taking sick leave beyond the maximum amount of time allowed, in violation of the Americans with Disabilities Act (ADA).

Hamilton Growers to Pay $500,000 to Settle EEOC Race / National Origin Discrimination Lawsuit

Hamilton Growers, Inc., doing business as Southern Valley Fruit and Vegetable, Inc., an agricultural farm in Norman Park, Ga., has agreed to pay $500,000 to a class of American seasonal workers – many of them African-American – who, the EEOC alleged, were subjected to discrimination based on their national origin and/or race, the agency announced today.  The agreement resolves a lawsuit filed by the EEOC in September 2011.

EEOC'S Phoenix Office and Mexican Consulates in Arizona Sign Historic Outreach Agreement

The Phoenix District Office of the U.S. Equal Employment Opportunity Commission (EEOC) entered into a Memorandum of Understanding with several consulates of Mexico in Arizona today. The agreement establishes an ongoing collaborative relationship between these entities to provide Mexican nationals with information, guidance and access to resources on the prevention of discrimination in the workplace, regardless of documentation status. Mexican consuls for Phoenix, Nogales, Tucson, Yuma, and Douglas, Ariz., signed the agreement with Rayford O. Irvin, director of the EEOC's Phoenix District Office.
