Amsted Rail to Pay $4.4 Million After Court Ruled It Used Discriminatory Hiring Practices

Amsted Rail Co., Inc., a leading manufacturer of steel castings for the rail industry, will pay $4.4 million and furnish other relief to settle a class disability discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the federal agency announced today. The EEOC had charged the Chicago-based company violated federal disability law when it disqualified job applicants based on the results of a nerve conduction test for carpal tunnel syndrome (performed by a third-party contractor) rather than conducting an individualized assessment of each applicant's ability to do the job safely.

The Collection and EEOC Reach Agreement to Resolve Sex Discrimination Case

MIAMI -- The U.S. Equal Employment Opportunity Commission (EEOC) and The Collection, a South Florida automobile dealership, have reached a voluntary conciliation agreement to resolve allegations of gender discrimination raised by an unsuccessful female job applicant, the federal agency announced today.

Following an investigation, the EEOC found that the company had discriminated in its hiring practices on the basis of gender by failing to hire enough females into the position of sales representative.

A North Dakota civil construction company operating in Minot, N.D., will pay $59,000 to settle a sexual harassment and constructive discharge lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the federal agency announced today. The EEOC's lawsuit charged that Keller Paving and Landscaping, Inc., violated federal law when it subjected a female employee to a hostile work environment based on her sex and to work conditions that were so intolerable she was forced to resign.

Heritage Home Group to Pay $50,000 to Settle EEOC Disability Discrimination Lawsuit

Heritage Home Group, LLC, a North Carolina corporation that designs, manufactures, sources and retails home furnishings, will pay $50,000 and provide other relief to settle a disability discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today. The EEOC charged that Heritage Home violated federal law when it failed to provide a machine operator at its Hickory Chair Company manufacturing plant in Hickory, N.C., an accommodation for his disability. The federal agency further charged that Heritage Home fired the employee because of his disability.

Jury Awards $5.1 Million For Workers in EEOC Religious Discrimination Case Against United Health Programs of America, Inc. And Cost Containment Group, Inc.

Following a three-week trial, on April 25, a unanimous Brooklyn federal jury found that United Health Programs of America, Inc, which provides discount medical plans, and its parent Cost Containment Group, Inc. ("CCG"), violated federal law by coercing 10 employees to engage in religious practices at work and by creating a hostile work environment for nine of them. The jury also found CCG violated federal law by firing one employee, Faith Pabon, who opposed these practices.

Court Orders Scottsdale Wine Bar to Pay $100,000  In EEOC Sexual Harassment and Retaliation Suit

A federal district court on March 21 ordered a Scottsdale, Ariz., wine bar to pay $100,000 for sexual harassment against two servers because of their actual or perceived sexual orientation and for retaliation against one for complaining about it, the U.S. Equal Employment Opportunity Commission (EEOC), which filed the suit, announced today.  The court also ordered injunctive relief against Scottsdale Wine Café, LLC, doing business as 5th & Wine.
