EEOC Files Subpoena Enforcement Action Against Psychological Dimensions, LLC

Federal agency seeks court order compelling contractor to produce information relating to its hiring investigation

DENVER – The U.S. Equal Employment Opportunity Commission (EEOC) announced today the filing of a federal court action to enforce two administrative subpoenas issued against Psychological Dimensions, LLC, a company which conducts psychological assessments for job applicants with the Arapahoe Sheriff’s Office (ACSO) and the Board of County Commissions for Arapahoe County (BCCAC).

The EEOC issued the subpoenas as part of its investigation into the hiring practices of ACSO and BCCAC under Title VII of the Civil Rights Act, the Americans with Disabilities Act (ADA), and the Age Discrimination in Employment Act (ADEA). As part of that investigation, the EEOC requested information from Psychological Dimensions concerning its pre-employment assessments.

After Psychological Dimensions declined to provide the requested information, the EEOC filed a subpoena enforcement action (EEOC v. Psychological Dimensions, LLC, Case No. 1:26‑mc‑00072-RBJ) in U.S. District Court for the District of Colorado. The action seeks a court order compelling the company to comply with the EEOC’s subpoenas so the agency can complete its investigation.

“Federal law gives the EEOC authority to obtain information necessary to determine whether an employer’s hiring practices comply with antidiscrimination statutes,” said Mary Jo O’Neill, regional attorney for the EEOC’s Phoenix District Office. “When a third-party refuses to provide information central to that inquiry, the EEOC will use all tools available to enforce its subpoenas.”

The EEOC’s Phoenix District Office has jurisdiction over Arizona, Colorado, Utah, Wyoming, and part of New Mexico.

The EEOC is the sole federal agency authorized to investigate and litigate against businesses and other private sector employers for violations of federal laws prohibiting employment discrimination. For public sector employers, the EEOC shares jurisdiction with the Department of Justice’s Civil Rights Division.
