EEOC and Office of Special Counsel Issue Revised Procedures For Coordinating Discrimination Charges

The U.S. Equal Employment Opportunity Commission (EEOC) and the Office of Special Counsel for Immigration Related Unfair Employment Practices, U.S. Department of Justice (OSC), announce the adoption of a revised Memorandum of Understanding (MOU) to reflect changes in the law and further promote the elimination of duplication in the agencies' enforcement efforts. The new MOU, which replaces the MOU adopted in 1989, was published today in the Federal Register.

EEOC SCORES MAJOR VICTORY IN MITSUBISHI LAWSUIT

CHICAGO -- The U.S. Equal Employment Opportunity Commission (EEOC) scored a major legal victory yesterday in its class action sexual harassment lawsuit against Mitsubishi Motor Manufacturing of America, Inc. Ruling in EEOC's favor, Federal District Court Judge Joe Billy McDade held that the agency could pursue its sexual harassment lawsuit as a class action "pattern or practice" suit. Mitsubishi had argued that a class action "pattern or practice" approach was not workable

EEOC ANNOUNCES PILOT PROJECTS TO TEST FOR EMPLOYMENT DISCRIMINATION

WASHINGTON -- The U.S. Equal Employment Opportunity Commission (EEOC) announced today that it has entered into contracts with the Fair Employment Council of Greater Washington, D.C., and the Legal Assistance Foundation of Chicago to conduct pilot projects to study the use of employment "testers" to detect hiring discrimination. EEOC AND U S WEST COMMUNICATIONS RESOLVE CASE THROUGH MEDIATION

MILWAUKEE -- Highlighting the success of the U.S. Equal Employment Opportunity Commission's new mediation program, the EEOC and U S WEST Communications today announced a settlement agreement involving the innovative new mediation process and a third-party mediator to reach a mutually agreeable resolution of a disability discrimination claim dating back to 1993 that affected 27 people.

EEOC ISSUES GUIDANCE ON APPLICATION OF ANTI-DISCRIMINATION LAWS TO COACHES' PAY AT EDUCATIONAL INSTITUTIONS

WASHINGTON -- The U.S. Equal Employment Opportunity Commission (EEOC) announced today the release of the Enforcement Guidance on Sex Discrimination in the Compensation of Sports Coaches in Educational Institutions. INTERNAL EEOC WORKING GROUP MAKES RECOMMENDATIONS FOR CHANGES IN THE FEDERAL SECTOR COMPLAINT PROCESS

WASHINGTON -- Based on the recommendations of an internal Working Group of the U.S. Equal Employment Opportunity Commission (EEOC), the agency is preparing to go forward with suggested ways to improve and streamline the federal sector EEO complaint processes. EEOC CHAIRMAN ANNOUNCES RESIGNATION

WASHINGTON -- In a letter to the White House today, U.S. Equal Employment Opportunity Commission Chairman Gilbert F. Casellas informed President Clinton that he would resign from the agency effective at the end of this year. EEOC RELEASES POLICY STATEMENT ON MANDATORY BINDING ARBITRATION

WASHINGTON -- The U.S. Equal Employment Opportunity Commission (EEOC) today issued the Policy Statement on Mandatory Binding Arbitration of Employment Discrimination Disputes as a Condition of Employment, supporting its position that agreements that mandate binding arbitration of discrimination claims as a condition of employment are contrary to the fundamental principles of employment discrimination laws. COMMISSION ISSUES GUIDANCE ON HOW TO COUNT EMPLOYEES FOR JURISDICTIONAL PURPOSES

EEOC ISSUES GUIDANCE ON THE USE OF WAIVERS

WASHINGTON -- The U.S. Equal Employment Opportunity Commission (EEOC) has issued policy guidance clarifying that the right of an individual to file a charge of employment discrimination with the Commission cannot be waived. The guidance also states that an individual's right to testify, assist, or participate in a Commission proceeding cannot be waived.
